1. Booking and Payment
1.1 A booking is confirmed only upon receipt of a signed contract and payment of a non-refundable booking fee.
1.2 The booking fee secures the date and is deducted from the final balance.
1.3 The remaining balance must be paid no later than 4 weeks prior to the wedding date unless otherwise agreed in writing.
1.4 Failure to pay the balance by the due date may result in cancellation of services.
2. Client Cancellation Policy
2.1 If the Client cancels 6 months or more prior to the wedding date, the Client remains liable for 50% of the total agreed fee.
2.2 If the Client cancels within 4 months of the wedding date, the Client remains liable for 70% of the total agreed fee.
2.3 If the Client cancels within 2 months of the wedding date, the Client remains liable for 100% of the total agreed fee, as it is unlikely the date can be rebooked.
2.4 All cancellations must be made in writing.
2.5 These cancellation terms reflect a genuine pre-estimate of loss in accordance with UK contract law.
3. Photographer Cancellation
3.1 In the unlikely event that the Photographer is unable to attend due to illness, injury, or other unforeseen circumstances, reasonable efforts will be made to arrange a suitable replacement.
3.2 If a replacement cannot be arranged, liability shall be limited to a full refund of monies paid.
3.3 Nothing in this agreement limits liability for death or personal injury caused by negligence.
4. Rescheduling
4.1 Requests to reschedule are subject to availability.
4.2 If available, payments made may be transferred to the new date.
4.3 If unavailable, the cancellation terms above apply.
5. Consumer Rights
5.1 Nothing in these Terms affects the Client’s statutory rights under the Consumer Rights Act 2015.
5.2 Services will be provided with reasonable care and skill.
6. Coverage and Cooperation
6.1 The Client agrees to provide a schedule and inform the Photographer of key moments and required group photographs.
6.2 The Photographer is not responsible for missed images due to interference, delays, venue restrictions, or circumstances beyond reasonable control.
7. Image Delivery
7.1 Editing style is at the Photographer’s professional discretion.
7.2 Images will be delivered within 8 weeks of the wedding date unless otherwise agreed.
7.3 RAW files will not be supplied.
8. Copyright and Usage
8.1 Copyright remains with Trethek Studio Weddings in accordance with the Copyright, Designs and Patents Act 1988.
8.2 The Client is granted a personal-use licence for printing and sharing images.
8.3 Images may be used for portfolio and promotional purposes unless the Client requests otherwise in writing before the wedding.
9. Public Liability Insurance
9.1 Trethek Studio Weddings holds full Public Liability Insurance (PLI) to cover accidental injury or property damage caused directly by the Photographer while providing services.
10. Limitation of Liability
10.1 In the unlikely event of total photographic failure or loss of digital files, liability shall be limited to a refund of payments received.
10.2 The Photographer shall not be liable for indirect or consequential loss.
11. Force Majeure
11.1 Trethek Studio Weddings shall not be liable for failure to perform obligations due to events beyond reasonable control, including severe weather, fire, flood, government restrictions, or other force majeure events.
12. Jurisdiction
12.1 This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and subject to the exclusive jurisdiction of the courts of England and Wales.
13. Agreement
13.1 By paying the deposit, you agree to these Terms and Conditions.
14. Photographer Meals
14.1 For Full Day packages only, it is customary (but not required) for the Client to provide a meal for the Photographer and any assisting team members present (up to three people depending on the package). Meals are not expected for Basic or Half Day packages.
